NIL FAQ

What is NIL?

In accordance with NCAA and state of Utah laws, student-athletes are allowed to earn compensation for their name, image and likeness (NIL). Opportunities to capitalize on NIL include but are not limited to:
  • Audio and video advertisements
  • Content creation and publication, including YouTube and other social media providers
  • Serving as a camp counselor or providing private lessons/coaching opportunities
  • Autograph sales
  • Personal brand merchandising
  • Special appearances

  • Promotion or endorsement of a business (as a brand ambassador or social media influencer)

Can I use Utah State logos?

Except as expressly authorized in writing, use of the Utah State trademarks (e.g., the name of USU, its logos, symbols, images, or facility names (e.g., Maverik Stadium)) is prohibited in NIL activities. Contact Aggie Sports Properties, the exclusive athletics multimedia rightsholder for Utah State Athletics, to inquire about mark usage.

Can I use Utah State facilities?

Subject to availability and the terms of a facility use agreement, USU Athletics facilities may be used for NIL activities provided the student-athlete pays the customary facility rental rate. Information on facility rentals can be found though Event Services.

Does a student-athlete need to disclose their NIL deal?

Yes. The USU Athletics Department requires student-athletes to disclose all NIL deals with the USU Athletics Compliance Office. Any NIL deals that equal or exceed $600 in value, must be disclosed in accordance with Utah H.B. 202.

What kinds of promotions are prohibited?

Utah H.B. 202 prohibits student-athletes from promoting the use of tobacco, e-cigarettes, vaping products, alcohol, marijuana, antibiotics and steroids, gambling services, adult entertainment and firearms.

Are there any restrictions on compensation for student-athletes?

Yes. Student-athletes may not receive compensation for NIL agreements without a quid pro quo, based on athletic performance, or where compensation is contingent on initial or continued enrollment at USU.

Can international student-athletes utilize NIL?

To protect against any immigration issues, international student-athletes should NOT enter into any NIL agreements without first discussing the opportunity with USU’s Office of Global Engagement or an independent legal advisor.
